“Beasts of Southern Wild,” “Les Miz” among Costume Designer Award nominees






LOS ANGELES (TheWrap.com) – Films as diverse as “Beast of the Southern Wild” and “Les Miserables” were among the nominees for the 15th annual Costume Designers Guild Awards announced Thursday by the organization.


Stephani Lewis was nominated for “Beasts” in the contemporary film category, along with Louise Stjernsward for “The Best Exotic Marigold Hotel,” Mark Bridges for “Silver Linings Playbook,” Jany Temime for “Skyfall” and George L. Little for “Zero Dark Thirty.”






Paco Delgado was nominated in the period film group, along with Jacqueline West for “Argo,” Jacqueline Durran for “Anna Karenina,” Joanna Johnston for “Lincoln” and Kasia Walicka-Maimone for “Moonrise Kingdom.”


The winners of the seven competitive awards will be announced at a gala on Tuesday, February 19, at the Beverly Hilton Hotel.


A special Lacoste Spotlight Award will be presented to Anne Hathaway. Producer, writer, comedian and creator of “Saturday Night Live” Lorne Michaels will receive the Distinguished Collaborator Award. Honorary Career Achievement Awards will be presented to costume designers Judianna Makovsky and Eduardo Castro for their outstanding work in film and television.

Well: Holly the Cat's Incredible Journey

Nobody knows how it happened: an indoor housecat who got lost on a family excursion managing, after two months and about 200 miles, to return to her hometown.

Even scientists are baffled by how Holly, a 4-year-old tortoiseshell who in early November became separated from Jacob and Bonnie Richter at an R.V. rally in Daytona Beach, Fla., appeared on New Year’s Eve — staggering, weak and emaciated — in a backyard about a mile from the Richter’s house in West Palm Beach.

“Are you sure it’s the same cat?” wondered John Bradshaw, director of the University of Bristol’s Anthrozoology Institute. In other cases, he has suspected, “the cats are just strays, and the people have got kind of a mental justification for expecting it to be the same cat.”

But Holly not only had distinctive black-and-brown harlequin patterns on her fur, but also an implanted microchip to identify her.

“I really believe these stories, but they’re just hard to explain,” said Marc Bekoff, a behavioral ecologist at the University of Colorado. “Maybe being street-smart, maybe reading animal cues, maybe being able to read cars, maybe being a good hunter. I have no data for this.”

There is, in fact, little scientific dogma on cat navigation. Migratory animals like birds, turtles and insects have been studied more closely, and use magnetic fields, olfactory cues, or orientation by the sun.

Scientists say it is more common, although still rare, to hear of dogs returning home, perhaps suggesting, Dr. Bradshaw said, that they have inherited wolves’ ability to navigate using magnetic clues. But it’s also possible that dogs get taken on more family trips, and that lost dogs are more easily noticed or helped by people along the way.

Cats navigate well around familiar landscapes, memorizing locations by sight and smell, and easily figuring out shortcuts, Dr. Bradshaw said.

Strange, faraway locations would seem problematic, although he and Patrick Bateson, a behavioral biologist at Cambridge University, say that cats can sense smells across long distances. “Let’s say they associate the smell of pine with wind coming from the north, so they move in a southerly direction,” Dr. Bateson said.

Peter Borchelt, a New York animal behaviorist, wondered if Holly followed the Florida coast by sight or sound, tracking Interstate 95 and deciding to “keep that to the right and keep the ocean to the left.”

But, he said, “nobody’s going to do an experiment and take a bunch of cats in different directions and see which ones get home.”

The closest, said Roger Tabor, a British cat biologist, may have been a 1954 study in Germany which cats placed in a covered circular maze with exits every 15 degrees most often exited in the direction of their homes, but more reliably if their homes were less than five kilometers away.

New research by the National Geographic and University of Georgia’s Kitty Cams Project, using video footage from 55 pet cats wearing video cameras on their collars, suggests cat behavior is exceedingly complex.

For example, the Kitty Cams study found that four of the cats were two-timing their owners, visiting other homes for food and affection. Not every cat, it seems, shares Holly’s loyalty.

KittyCams also showed most of the cats engaging in risky behavior, including crossing roads and “eating and drinking substances away from home,” risks Holly undoubtedly experienced and seems lucky to have survived.

But there have been other cats who made unexpected comebacks.

“It’s actually happened to me,” said Jackson Galaxy, a cat behaviorist who hosts “My Cat From Hell” on Animal Planet. While living in Boulder, Colo., he moved across town, whereupon his indoor cat, Rabbi, fled and appeared 10 days later at the previous house, “walking five miles through an area he had never been before,” Mr. Galaxy said.

Professor Tabor cited longer-distance reports he considered credible: Murka, a tortoiseshell in Russia, traveling about 325 miles home to Moscow from her owner’s mother’s house in Voronezh in 1989; Ninja, who returned to Farmington, Utah, in 1997, a year after her family moved from there to Mill Creek, Wash.; and Howie, an indoor Persian cat in Australia who in 1978 ran away from relatives his vacationing family left him with and eventually traveled 1,000 miles to his family’s home.

Professor Tabor also said a Siamese in the English village of Black Notley repeatedly hopped a train, disembarked at White Notley, and walked several miles back to Black Notley.

Still, explaining such journeys is not black and white.

In the Florida case, one glimpse through the factual fog comes on the little cat’s feet. While Dr. Bradshaw speculated Holly might have gotten a lift, perhaps sneaking under the hood of a truck heading down I-95, her paws suggest she was not driven all the way, nor did Holly go lightly.

“Her pads on her feet were bleeding,” Ms. Richter said. “Her claws are worn weird. The front ones are really sharp, the back ones worn down to nothing.”

Scientists say that is consistent with a long walk, since back feet provide propulsion, while front claws engage in activities like tearing. The Richters also said Holly had gone from 13.5 to 7 pounds.

Holly hardly seemed an adventurous wanderer, though her background might have given her a genetic advantage. Her mother was a feral cat roaming the Richters’ mobile home park, and Holly was born inside somebody’s air-conditioner, Ms. Richter said. When, at about six weeks old, Holly padded into their carport and jumped into the lap of Mr. Richter’s mother, there were “scars on her belly from when the air conditioner was turned on,” Ms. Richter said.

Scientists say that such early experience was too brief to explain how Holly might have been comfortable in the wild — after all, she spent most of her life as an indoor cat, except for occasionally running outside to chase lizards. But it might imply innate personality traits like nimbleness or toughness.

“You’ve got these real variations in temperament,” Dr. Bekoff said. “Fish can by shy or bold; there seem to be shy and bold spiders. This cat, it could be she has the personality of a survivor.”

He said being an indoor cat would not extinguish survivalist behaviors, like hunting mice or being aware of the sun’s orientation.

The Richters — Bonnie, 63, a retired nurse, and Jacob, 70, a retired airline mechanics’ supervisor and accomplished bowler — began traveling with Holly only last year, and she easily tolerated a hotel, a cabin or the R.V.

But during the Good Sam R.V. Rally in Daytona, when they were camping near the speedway with 3,000 other motor homes, Holly bolted when Ms. Richter’s mother opened the door one night. Fireworks the next day may have further spooked her, and, after searching for days, alerting animal agencies and posting fliers, the Richters returned home catless.

Two weeks later, an animal rescue worker called the Richters to say a cat resembling Holly had been spotted eating behind the Daytona franchise of Hooters, where employees put out food for feral cats.

Then, on New Year’s Eve, Barb Mazzola, a 52-year-old university executive assistant, noticed a cat “barely standing” in her backyard in West Palm Beach, struggling even to meow. Over six days, Ms. Mazzola and her children cared for the cat, putting out food, including special milk for cats, and eventually the cat came inside.

They named her Cosette after the orphan in Les Misérables, and took her to a veterinarian, Dr. Sara Beg at Paws2Help. Dr. Beg said the cat was underweight and dehydrated, had “back claws and nail beds worn down, probably from all that walking on pavement,” but was “bright and alert” and had no parasites, heartworm or viruses. “She was hesitant and scared around people she didn’t know, so I don’t think she went up to people and got a lift,” Dr. Beg said. “I think she made the journey on her own.”

At Paws2Help, Ms. Mazzola said, “I almost didn’t want to ask, because I wanted to keep her, but I said, ‘Just check and make sure she doesn’t have a microchip.’” When told the cat did, “I just cried.”

The Richters cried, too upon seeing Holly, who instantly relaxed when placed on Mr. Richter’s shoulder. Re-entry is proceeding well, but the mystery persists.

“We haven’t the slightest idea how they do this,” Mr. Galaxy said. “Anybody who says they do is lying, and, if you find it, please God, tell me what it is.”

Since he did not speak English fluently, my father worked as a janitor and had a second job as a hospital security guard. He later took a third job driving a taxi at night to pay for my tuition at Nazareth Regional High School, a Roman Catholic school in Brooklyn. My parents were determined that I was going to get a good education, and wanted to keep me away from local troubles, which did claim two of my childhood friends.


Working so many jobs overwhelmed my father. He had a heart attack and died at age 59 behind the wheel of his taxi. My mother found it difficult to cope without my father and moved back to Haiti in 1989 with two of my siblings. I thought I would have to leave school because I had no money for tuition, but Nazareth agreed to pay my way.


I wound up sleeping in my car for almost three months, showering at school after my track team’s practice. I also held down two jobs, both in retailing, and one of my sisters and I rented a basement apartment in East Flatbush.


After graduating from high school in 1990, I attended St. Francis College in Brooklyn, on athletic and academic scholarships. I worked first at the New York City Board of Education, where H. Carl McCall was president, then in his office after he became New York State comptroller. I later worked in the office of Ruth Messinger, then the Manhattan borough president.


I broadened my nonprofit organization experience at the Faith Center for Community Development while earning my master’s of public administration at New York University. I married my high school sweetheart, Melissa, and we now have two children.


In 2001, I began to work toward my original goal — improving educational opportunities for children — and joined the city’s Department of Education. I was later recruited under the new administration of Mayor Michael R. Bloomberg to help start a program as part of his Children First reforms.


In 2003, I became the Department of Education’s executive director for parent and community engagement, and, two years later, senior counselor to Joel I. Klein, then the school chancellor. He taught me a great deal about leadership and how to change the education system. But I began to realize public education could not be transformed without great principals who function like C.E.O.’s of their schools.


So in 2006 I returned to the nonprofit world, to New Leaders, a national organization founded in 2000 to recruit and develop leaders to turn around low-performing public schools. Initially, I managed city partnerships and expanded our program in areas like New Orleans and Charlotte, N.C.


In 2011, I became C.E.O., and revamped our program to produce even stronger student achievement results, streamlined our costs, diversified funding sources and forged new partnerships. We have an annual budget of $31.5 million, which comes from foundations, businesses, individuals and government grants, and a staff of about 200 people at a dozen locations.


We have a new partnership with Pearson Education to provide greater learning opportunities to public school principals. The goal of these efforts is to have a great principal in each of our nation’s public schools — to make sure that, just as I did, all kids get a chance at success.

A backyard nuclear shelter? Yes, paranoia does sell








One sterling quality of American businesses is that they'll try to make money from anything.


Paranoia, for instance. So say hello to Ron Hubbard, the owner of Montebello-based Atlas Survival Shelters, which converts huge corrugated metal tubes up to 50 feet long into fully equipped, all-the-comforts-of-home underground shelters at a price of up to about $78,000 each, not including shipping and interment.


You may have spotted the Atlas shop from the 5 Freeway as you're heading into downtown. There's a corrugated tube out front, painted bright yellow and looking like a tipped-over corn silo. High on the exterior wall facing the road is a banner declaring that the shelters offer protection from nuclear blasts, nuclear fallout, EMP (that's electromagnetic pulses, which can foul electrical systems), solar flares, mobs, looters, earthquakes and chemical warfare. If there's anything left off that list, it's probably not worth worrying about.






"People who buy my shelters are not radical crazy people," Hubbard told me recently as he guided me around the Montebello shop. "I get maybe three crazy calls a year. They're practical people."


Hubbard, 50, is a big Texan with a toothy grin and the friendly enthusiasm of someone trying to sell you something. He'll expound cheerily on the basic practicality, not to mention the sheer joy, of having a 40-foot corrugated steel drum buried 20 feet deep in your yard and tricking it out with a big-screen TV and Internet connection for those long days and nights hunkered down against nuclear blasts, the Chinese army or domestic looters. His shelters also offer such necessities as microwave ovens, space for a year's worth of provisions and high-grade air filtration.


"We don't know where our country will go," he said. "If we're going to be attacked, my shelters will protect you from Sarin gas or super flu. If we go bankrupt and we don't pay China, that could be the start of World War III. We could attack Iran or back Israel, and that could start a war. This is insurance. Why do we carry insurance on our homes? Just. In. Case."


Hubbard doesn't describe these dystopias as though he actually believes in them, but rather with the air of a salesman trying out any buzzword that might trigger a deal. During the couple of hours we were together, he described his products serially as underground condos, second homes, combination second homes and bomb shelters, man caves, man caves that happen to be bombproof, weekend cabins and hunting cabins.


Atlas Survival Shelters hasn't turned a significant profit yet. Hubbard said it made no money in the start-up year of 2011, was modestly in the black last year and may show a profit for 2013. But the business is unusual enough that it has won featured spots on several reality shows. An episode on A&E Network's "Shipping Wars" shows a team of moving experts trying to figure out how to transport a 32-foot shelter on their flatbed truck. During the episode Hubbard regales them with the virtues of the unit's escape-hatch feature, a second portal that opens only from the inside, in case of an attack.


"Somebody sees you going down; while they're trying to smoke you out, you're going to the back tunnel, you're gonna come up through an escape hatch that's hidden underground, you can shoot 'em in the back. Pretty cool, huh?" (Remarked one of the show's plainly creeped-out female cast members, "Remind me to never pay him a visit.")


More recently, Atlas was featured on an episode of the National Geographic Channel series "Doomsday Preppers," which chronicles the lifestyles of the scared and nervous. Hubbard's customer is described in network publicity as Brian Smith, a father of 12 "preparing for a total collapse of the U.S. monetary system."


Hubbard got into the underground shelter business a little more than a year ago after years of selling wrought-iron doors from the same location, operating as Hubbard Iron Doors. That business was brought low by the poor economy and cheap Chinese knockoffs, Hubbard says. It filed for bankruptcy in 2011; Hubbard says it's now owned and run by his brother, though the two companies share space with each other.


While he was casting about for a new business, Hubbard said, he happened across a brochure for Radius Engineering International, a Texas company that manufacturers fiberglass shelters mostly for business, government and military buyers. But the Radius products were expensive — they run from $150,000 up to millions, depending on the design and capacity. Hubbard thought he could do better on price while turning out a more appealing hideaway.


He's still trying to get a feel for the market, however. With his six or seven full-time workers, he can turn out one shelter a week. Orders, he said, come in at somewhere between one a month and one a week, more in periods of publicity-driven paranoia — during the run-up to the supposed Mayan apocalypse at the end of December, he said, calls jumped up to one a day.


The joke was on the callers, however, because Hubbard's six-week lead time meant that no one who called because they had just seen a Mayan feature on TV could get a shelter built, much less on site and in the ground, in time to beat the end of the world. Luckily, the apocalypse was a bust.


And for all that he plays up Armageddon in all its possible varieties in his sales pitch, doomsday may not be that great a marketing tool. "If I just sold bomb shelters, there would be about this big of a market." Hubbard holds his thumb and forefinger a half-inch apart. "But if I say, 'man cave,' 'wine cellar,' 'getaway,' then I get the recreational shelter owner too."


He says most of his calls come from retired military men, doctors, lawyers and business owners — possibly because the latter are among the few categories of buyers with the wherewithal to plunk down $60,000 or $70,000 for a man cave/bomb shelter, plus installation.


The size of the overall shelter market is unclear, in part because its promoters make a point of secrecy about whom they sell to and where. Privately held Radius has claimed to sell more than $30 million worth of shelters a year, but you have to take their word for it.


Then there are firms like Vivos Group, a Del Mar, Calif., company that claims to have started survivalist communities in three states — but they appear to be sort of co-op arrangements in which you have to apply to be considered for "co-ownership" of your refuge community. Once you're chosen, they'll let you know where to go when the end times come.


"This is just the threshold of something that's going to become common," Hubbard said, putting a hopeful spin on his words as though aware that paranoia may be peaking today, but gone tomorrow. "So I say, don't buy a bomb shelter. Buy an underground cabin, and enjoy it."

John Powers, author who wrote about growing up Catholic, dies






(Reuters) – John Powers, a U.S. author and motivational speaker who wrote about his experiences growing up Catholic in Chicago including the novel “Do Black Patent Leather Shoes Really Reflect Up?” has died, his family said on Thursday.


Powers, 67, died late Wednesday of natural causes at his home in Lake Geneva, Wisconsin, his daughter Jacey Powers said.






A product of a working-class neighborhood, Powers wrote what he called humorous social portraits in columns to novels, a musical based on “Black Patent Leather Shoes” and more recently wrote and performed one-man shows.


“He cherished every moment and lived with tremendous passion and motivated others to do the same,” Jacey Powers said.


Powers lived the last 25 years in Lake Geneva, spending almost all of his time writing on the front porch, she said.


“He had just finished rewriting his one-man show and wanted to put it up,” Jacey Powers said. “(He) was always looking for new ways to reinvent himself and to find the next challenge and to live life better.”


A self-described “horrible” student at a Catholic high school – his motivational speaking website says he graduated in the bottom 3 percent of his class – he liked to say he was the only student in school history to fail music appreciation.


Powers went on to earn a bachelor’s degree from Loyola University Chicago, and a master’s and doctorate from Northwestern University and became a college professor himself for six years.


Other books by Powers include “The Last Catholic in America” and “The Unoriginal Sinner and the Ice-Cream God.”


Visitation and services are planned for Sunday at The Chapel on the Hill in Lake Geneva.


Powers is survived by his wife, JaNelle Powers, and daughters Jacey Powers and Joy Powers.

Business Briefing | Medicine: F.D.A. Clears Botox to Help Bladder Control



Botox, the wrinkle treatment made by Allergan, has been approved to treat adults with overactive bladders who cannot tolerate or were not helped by other drugs, the Food and Drug Administration said on Friday. Botox injected into the bladder muscle causes the bladder to relax, increasing its storage capacity. “Clinical studies have demonstrated Botox’s ability to significantly reduce the frequency of urinary incontinence,” Dr. Hylton V. Joffe, director of the F.D.A.’s reproductive and urologic products division, said in a statement. “Today’s approval provides an important additional treatment option for patients with overactive bladder, a condition that affects an estimated 33 million men and women in the United States.”

DealBook: Despite Improving Profits, Morgan Stanley's Path Is Uncertain

Morgan Stanley has taken aggressive action to bolster profit. Over the last year, the Wall Street bank has cut thousands of employees, sold costly assets and retooled major businesses.

Those efforts worked. In the fourth quarter, Morgan Stanley reported earnings of $481 million, in contrast to a loss of $275 million in 2011. Profit was equally strong for the year.

But the path to future growth is less clear. While the financial firm can find other ways to cut costs, its core operations face significant challenges, from both internal and external forces. Reflecting those issues, revenue was flat last year, excluding charges related to its debt.

“They are doing everything they can to boost returns,” said Glenn Schorr, an analyst at the Japanese bank Nomura. “But given the environment and the state of their franchise, they can only do so much.”

Investors are assessing the progress versus the prospects.

After Morgan Stanley beat analysts’ expectations, the bank’s shares increased nearly 8 percent, to close at $22.38 on Friday. Morgan Stanley’s stock is up nearly 50 percent since early 2012.

“The company has been steadily chipping away at areas of investor concern, and has shown evidence of that progress,” Roger Freeman, a Barclays analyst, wrote in a note to investors.

Still, investors don’t value the investment bank as highly as some of its peers.

Morgan Stanley is trading at approximately 70 percent of its book value, a crucial financial measure that refers to the liquidation value of a company’s assets if it were forced to sell everything. Goldman, in contrast, is trading at book value.

More than four years after the financial crisis, Morgan Stanley has emerged as a much stronger, albeit smaller, bank.

After getting badly bruised during the crisis, Morgan Stanley, under the leadership of James P. Gorman, the chief executive, has moved to remake itself. He has diversified operations, emphasizing less risky businesses like wealth management.

That group was a particular bright spot. In the latest quarter, wealth management, with its 16,780 financial advisers, posted decent revenue growth. Pretax profit margin rose to 17 percent, up from 7 percent a year ago. That trumped the firm’s internal goals of 15 percent.

Investment banking, too, showed signs of strength. The group posted revenue of $1.23 billion in the fourth quarter, up 26 percent from the previous year.

The bank has also cut expenses significantly to help drive profitability. In 2012, Morgan Stanley reduced its head count by 7 percent, to 57,061 employees. It laid off 1,600 people this month.

The firm has also been bringing its pay levels down modestly. The firm’s compensation ratio, excluding certain charges, came in at roughly 51 percent, down from 57 percent a year ago.

Such efforts will most likely continue. On Friday, the bank said it might cut expenses by as much as $1.6 billion over the next two years.

Mr. Gorman called this quarter “pivotal,” on Friday. “I am confident we are on the path to increasing shareholder value that will be evident regardless of the macro environment,” he said in a statement.

Even so, the latest results underscored the growing gap between the bank and its rivals.

Revenue was flat for the quarter at Morgan Stanley, while it increased by 19 percent at Goldman Sachs during the same period. Excluding charges related to its debt, Morgan Stanley’s return on equity, a measure of profitability, was 5 percent. That compares with 10.7 percent at Goldman. To simply cover its debt expenses and other capital costs, Morgan Stanley needs to achieve a return on equity closer to 10 percent.

The firm’s problem child is the fixed income department.

Fourth-quarter revenue from fixed income sales and trading, headed by Ken deRegt, was $811 million, excluding the charges related to the firm’s debt. This was well below analysts’ forecasts. The bank was hurt by poor results in commodities trading, Mr. Gorman said in an interview on CNBC. He said it was a “terrible quarter,” citing factors like Hurricane Sandy, adding that it was one of the worst for the commodities business since 1995.

Despite its successes, Morgan Stanley faces a tough road.

The bank, which has had its credit rating cut deeper than its rivals, is also adjusting to a new regulatory environment. It now has to put up more capital against its operations, forcing the bank to leave certain businesses, reducing profitability.

Morgan Stanley is also trying to build market share in less-capital-intensive businesses like interest rates trading. But it is a highly competitive area, with lower margins.

“They have made some clear progress, but still have their work cut out for them in fixed income,” said Mr. Schorr of Nomura.

Algeria raid puts a lawless region in the spotlight









CAIRO — The offensive by Algerian soldiers to free hostages at a natural gas complex has refocused world attention on the dangers of a lawless desert region bristling with gunrunners, smugglers and a virulent strain of Islamic ideology.


Coming days after French airstrikes on Islamist militants in neighboring Mali, the raid Thursday killed or wounded many militants and an unspecified number of Western and Algerian hostages, the Algerian government said. Officials in Algiers, the capital, said late in the evening that they had wrapped up the assault on the compound near the Algerian-Libyan border deep in the Sahara desert.


"The operation resulted in the neutralization of a large number of terrorists and the freeing of a considerable number of hostages," Communications Minister Mohamed Said Belaid told state-run media. "Unfortunately we deplore also the death of some.... We do not have final numbers."





The Algerian news agency said 45 hostages, including Americans, escaped the site. But later Algerian media reports indicated that only four to six foreign hostages were freed and that there were a number of "victims."


A Mauritanian news organization quoting a militant spokesman suggested that gunfire from Algerian military helicopters struck two vehicles attempting to flee the compound, killing 35 foreigners and 15 kidnappers, including the militant group's commander. The differing accounts were impossible to confirm or reconcile and epitomized a chaotic day that appeared to raise questions from Western leaders over the operation's planning.


In addition to as many as seven Americans, captives included Algerians, Britons, Japanese, Norwegians and other foreigners.


The army raid marked a surprising twist in a drama that had raised fears of a long siege and highlighted the revived Islamist extremism in the region.


To the west of Algeria lies Mali, where Islamist rebels have intensified their fight in recent days to overthrow the government, prompting French military action backed by American logistical support. To the east lie Tunisia and Libya, where revolutions beginning in 2010 overthrew President Zine el Abidine ben Ali in Tunis and Moammar Kadafi in Tripoli.


Since then, militant and radical Islamist groups, including Algeria's Al Qaeda in the Islamic Maghreb, have become more emboldened amid the political upheaval of new governments. Western countries have grown increasingly concerned that North Africa could become a seedbed for international terrorism.


The hostage drama unfolded in a gas field known as In Amenas, close to the border with Libya, a country of particular concern to Algeria. Extremists and weapons looted from Kadafi's military and police have flowed across the border for months.


Farther east, Egyptian authorities are concerned that militants from Algeria and Libya have joined terrorist cells in the Sinai Peninsula along the Israeli border.


It was the strife in Mali, however, that apparently led to the militant takeover of the Western-run gas compound Wednesday. The Algerian militants, who belonged to an Al Qaeda-linked group called the Signed-in-Blood Battalion, said they were acting in retaliation for French airstrikes against advancing Malian rebels. They reportedly threatened to blow up the plant if Algerian commandos attempted to free the hostages.


After the compound was seized by the militants, hundreds of Algerian soldiers firing warning shots ringed the remote compound as helicopters skimmed overhead. The militants asked for safe passage to Libya, with the hostages accompanying them. Algerian officials, who over the years have cracked down harshly on Islamic radicals, said they would not consider such requests.


"The authorities do not negotiate, no negotiations," Interior Minister Daho Ould Kabila said on state television. "We have received their demands, but we didn't respond to them."


The Algerian government was under pressure from the U.S., Britain and other countries whose nationals were taken hostage. But the raid caught some by surprise and appeared to irritate some Western leaders. British Prime Minister David Cameron's office said he would have preferred to have been told in advance of the operation.


"I think we should be prepared for the possibility of further bad news, very difficult news in this extremely difficult situation," Cameron said.


The State Department declined to provide details of the Algerian offensive, saying it could endanger hostages, some of whom were reportedly forced to wear explosives-laden belts.


White House spokesman Jay Carney told reporters, "We are certainly concerned about reports of loss of life and we are seeking clarity from the government of Algeria."


The Algerians are "used to fighting terrorism, in their own, quite hard way," said Mathieu Guidere, a professor of "Islamology" at the University of Toulouse in France and author of "The New Terrorists." "It's likely the deaths at the petrol base were as a result of the assault by the Algerian security forces."


Reports have suggested that as many as 41 foreigners were being held along with scores of Algerians. An Irishman who was among them contacted his family to say he had been freed.


The natural gas field complex at In Amenas, which supplies Europe and Turkey, is a joint venture operated by BP; Statoil, a Norwegian firm; and Sonatrach, the Algerian national oil company.


The assault on the compound dramatically changed the dynamics of Algeria's decades-long campaign against radicals. Militants had rarely, if ever, targeted oil and gas operations, even during the 1990s civil war, when few rules applied amid beheadings and massacres. Their seizure of the compound was a direct strike at the government and the nation's economic and political stability.


The civil war in Algeria, a country rich in oil and gas and with a spectacular coast and vast deserts, killed more than 100,000 people. The conflict began when the military, fearing Islamists would come to power, shut down parliamentary elections and the country collapsed into turmoil.


The government offered an amnesty program more than a decade ago. Thousands of militants accepted, but hard-core members of what had become Al Qaeda in the Islamic Maghreb resisted. The group publicly joined Al Qaeda in 2006, sending recruits to fight U.S. forces in Iraq while expanding its suicide bombings and kidnappings of businessmen and Westerners for ransom in Algeria.


AQIM and other Algerian radicals are heavily armed and fluid, shifting much of their attention last year to neighboring Mali, where they joined rebels and Islamists in a war to overthrow the government. Mali has attracted extremists from across Africa and the Middle East who are attempting to exploit the country's instability to create an Islamist state.


Two top radicals are believed to be connected to the gas field seizure: Abdelmalek Droukdel, AQIM's leader, who has called for militants to target France over its intervention in Mali, and Mokhtar Belmokhtar, a mercurial, one-eyed smuggler and kidnapper who runs the Signed-in-Blood Battalion, an AQIM splinter group that claims to have carried out Wednesday's predawn attack.


The hostages at the complex "who managed to reach loved ones abroad said the terrorists that captured them have Egyptian, Tunisian, Libyan accents," said an Algerian risk-assessment analyst who asked to remain anonymous because of the sensitivity of his job.

Facebook Wants New Breed of Flash Memory for Storing Old Pics



With each passing day, more than 350 million digital photos find their way onto Facebook, joining the more than 240 billion that are already there. Jay Parikh is the man who makes sure all those photos can remain online from now until the end of time, and that’s going pretty well. But he wants a little help. He wants the world to build him a new kind of flash memory ideally suited to storing all those old pics you rarely look at anymore.


The way things are going, he’ll probably get it. As Facebook’s vice president of infrastructure engineering, Parikh oversees the development of both the software and the hardware needed to operate the world’s most popular social network, and in recent months, he and his colleagues have developed a certain knack for convincing the world’s hardware companies to build stuff that suits Facebook’s particular needs — and the needs of other massive online operations. Just yesterday, Intel, AMD, and two other chip makers put their weight behind Facebook’s effort to create a new type of server that lets you add and remove processors whenever you like.


In the spring of 2011, Facebook founded something called the Open Compute Project, hoping to remake the hardware industry through communal collaboration, and on Wednesday, even as the company was showing off the latest fruits of the project, Parikh was calling for more.


Today, Facebook stores all your photos on good old-fashioned mechanical hard disks. This works well enough, but now that the company is juggling hundreds of billions of photos, many of them dating back three or four years, it makes less sense by the day. Those older photos aren’t accessed that often, and if they remain on hard drives, they continue to sap relatively large amounts of power.

Traditionally, companies have moved their older digital data to, say, magnetic tape. With Facebook, there’s an added rub. Even those older photos must be stored in a way that lets you instantly retrieve them. “We can’t say: ‘Hey, you want to look at that picture from Halloween five years ago? We’ll go grab the tape and put it on the drive and send it to you in the week,’” Parikh explained on Wednesday, during a speech at the Open Compute Project’s latest summit meeting. “That just doesn’t work.”


Parikh and company could move those older photos to the sort of flash memory devices that are now invading other parts of the computer data center — devices that consumes far less power than hard disks — but these carry relatively high price tags. Today’s super-speedy flash devices are a great to store information that’s accessed all the time, but they’re too expensive for the kind of “cold storage” Facebook needs for old photos.


So Parikh wants someone to build him some flash storage that’s cheaper. Basically, today’s flash is built to maximize the number of reads and writes you can make — the medium tends to degrade as you read and write — but he wants a version that specifically designed for data that’s accessed only occasionally.


“We want something with a low write-endurance,” he told us on Wednesday. “We want to get to something with a much, much lower unit cost per gigabyte.” This will also reduce the company’s power consumption, and according to Parikh, it will give his engineers more flexibility when it comes to writing software. “You play all sorts of neat software tricks in terms of how you optimize it.” When you’re reading and writing data on spinning hard drive platters — and you want to keep speeds up — there are tight restrictions on how you can do so.


On stage, during his speech, Parikh likened storage devices to cars. Right now, he said, it was as if his only options were a minivan and a high-end sports car. What he really wants is a third option — something more like a Prius. “We want is a continuum of options,” he said. “Today, the spectrum is very coarse. There’s tape on one end. There’s flash on the other end. And spinning disks in the middle. And that’s it.”


That may seem like a tall order, but Facebook is now so large — and so influential — it can make such requests in earnest. According to Facebook hardware design and supply chain guru Frank Frankovksy, Facebook engineers have long worked hand-in-hand with the Utah-based flash storage outfit Fusion-io, playing directly into the company’s latest designs, including the new 3.2 terabyte flash introduced on Wednesday at the Open Compute Summit, and Fusion-io chief David Flynn is only too happy to advertise this relationship.


Fusion-io’s high-speed flash cards are already driving Facebook’s database software — where so much of your text-based today is stored — but someday, Facebook will also move flash into the cold storage facility it’s building outside its data center up in Prineville, Oregon. It needs to get its hands on an entirely new type of flash before that can happen. But that shouldn’t be a problem.

Eclectic opening for Sundance with films about Mideast, Chile, U.S. Southwest






PARK CITY, Utah (Reuters) – The Sundance Film Festival opens Thursday with movies and documentaries from around the world, including a feature that examines the cultural divide between the Middle East and the United States.


The 10-day Sundance Film Festival, founded by actor-director Robert Redford and now in its 35th year, will showcase 119 films from 32 countries.






“May in the Summer,” the U.S. dramatic competition opener, comes from writer-director Cherien Dabis, who caught the eye of Sundance organizers in 2009 with her directorial debut “Amreeka,” about a Palestinian family‘s experiences living in post 9/11 America.


Palestinian-American Dabis, 36, reverses the perspective on the Middle East, showing a Jordanian woman who has established a successful life in America but undergoes an identity crisis when she returns to her family in Jordan to plan her wedding.


“May in the Summer” will join U.S. documentary “Twenty Feet from Stardom” about back-up singers, Chilean drama “Crystal Fairy,” “Who is Dayani Cristal,” about a mysterious corpse found in the Arizona desert, and five short films as part of the opening day roster at the world’s leading independent film festival.


“We want the kind of films that will really set the tone for the rest of the festival. Those four films do that perfectly. They’re very different in what they are, but they collectively represent what’s going to be unfolding over the next days,” festival director John Cooper told Reuters.


OPENING UP TO THE WORLD


Festival organizers are making efforts this year to encourage more international stories and filmmakers to come to Sundance.


“They saw the value in the continuing changing world we live in and that even American stories are coming from all over the world,” Dabis said.


“The movie is a universal story that’s set in the Middle East, and we all know the Middle East is a place where we all need to expand our perceptions of what life is like there,” she added.


Sundance founder Robert Redford said the festival was all about encouraging diversity in filmmaking.


“As long as we go forward and we adapt to change, we keep in touch with our original purpose which is simply to support and develop new voices to be seen and heard,” Redford told reporters at a news conference on Thursday.


In addition to the usual film competition and premiere categories, festival organizers have expanded their slate of edgier films and projects, including actor James Franco’s sexually explicit films “kink” and “Interior. Leather Bar.”


There is also a thriving short film initiative, with more than 40 films showcased.


Outside of the films, Sundance has become a hot spot for the film industry to escape the hustle of Hollywood’s awards season and relax in Sundance’s more relaxed vibe.


Live music will feature prominently, with a spotlight on electronic dance music and four pop-up clubs featuring DJs such as Nero and Afrojack.


VIPs can take private snowboarding lessons or take part in the culinary event ChefDance, in a fusion of food and film.

Well: The Fallout of a Chance Medical Finding

An incidental finding — I was convinced of it. My patient had undergone a CT scan of the abdomen at another hospital because of stomach pains and “incidentally noted” was a 2-centimeter mass in her adrenal gland. She brought in the report for me to see, nervous that she might have cancer.

I reassured her that it was exceedingly unlikely that she had cancer. Benign masses in the adrenal gland are nearly as common as birthmarks. They almost never cause symptoms and we stumble across them only because we do so many scans for other reasons. They’ve even earned their own appellation: incidentalomas, and that’s what I was sure she had.

Of course a tiny fraction — 1 to 2 percent — of these adrenal masses can wreak havoc by churning out an excess of adrenal hormones or by being cancerous. Luckily, the mass on my patient’s scan possessed all the reassuring characteristics of benignity: it was small, low-attenuating, well circumscribed, with smooth borders. And she had no symptoms to suggest adrenal hyperactivity or cancer. It was most likely a benign adrenal adenoma that would never cause her harm.

Nevertheless, once the incidentaloma had been given life, so to speak, it was no longer incidental. We were now obliged to run some highly complicated — and expensive — lab tests. I winced as I ordered urinary metanephrines to test the adrenaline-producing capacity of the adrenal. The computer warned me with exclamation points and asterisks that this was a “greater-than-$100-send-out test.” Explaining how to correctly collect a 24-hour urine sample was its own involved discussion. Then I had to explain the even more complicated logistics of the overnight dexamethasone-suppression test to evaluate the cortisol-producing capacity of the adrenal.

After that, I considered the follow-up CT scans, recommended at six months, one year and two years, to ensure that the mass wasn’t growing. What about all that radiation? One group of endocrinologists estimated that the chance of uncovering a malignant cancer in patients like mine was roughly equal to the chance of causing a fatal cancer from the radiation of these follow-up CT scans. And might these CT scans pick up other incidental findings, opening yet more Pandora’s boxes of medical evaluation?

And what about the issue of skyrocketing medical costs? The evaluation of this incidentaloma was going to cost more than a thousand dollars. Tens of millions of CT scans are done every year in the United States. It doesn’t take many back-of-the-envelope calculations to see how quickly the costs of incidental findings, and their subsequent evaluations, add up. How much should the societal obligation weigh into the decisions for my patient?

My thoughts flitted back to the doctor who had ordered this CT in the first place. Perhaps if the doctor had had more time to spend on the history and physical, the CT would not have been necessary. From my 15 years with this patient, I knew that her symptoms could be voluminous in quantity and quality. This wasn’t to say that something serious couldn’t squeak in, but over the years I have learned that it takes immense perseverance and patience to tease out the significance of each symptom. Otherwise we’d be doing a CT every week for her.

But I could understand how a doctor in a busy ER on a weekend might have been overwhelmed by the plethora of symptoms and simply ordered a CT “to be on the safe side.” I wished that doctor had tried to call me before ordering the scan, but what’s done was done. The fallout of that decision was now in my lap.

By now we had run well over our allotted time and my patient was utterly overwhelmed by the complex testing procedures and schedules. The adrenal mass was an incidental finding, after all, but it had completely steamrolled our visit. My patient’s diabetes, obesity, depression, arthritis and elevated cholesterol all ended up with the short end of the clinical stick — an outcome that surely is not incidental to her health.

Media Decoder Blog: Tribune Company Names Peter Liguori as Chief After Ending Bankruptcy

Peter Liguori, a longtime television executive, was named the new chief executive of the Tribune Company on Thursday, two and a half weeks after the newspaper and television station owner emerged from a wrenching four-year bankruptcy process.

Mr. Liguori’s appointment had been expected for more than a month.

Analysts expect Tribune to sell some of its newspaper assets and rely more heavily on its television stations and Web sites as it restructures itself in the months ahead.

Tribune’s newspaper holdings include The Chicago Tribune, The Los Angeles Times and The Baltimore Sun. In an interview with The Los Angeles Times on Thursday, Mr. Liguori acknowledged that there were potential buyers for some of the newspapers and that “it is my fiduciary responsibility to hear them out and see if in fact their interest is real and their commitment is concomitant with the value of these newspapers.” But he also emphasized an internal goal to maximize revenue from the newspapers.

In an e-mail message to employees, Mr. Liguori brought up the television stations first, saying, “We must find efficient ways to create our own fresh programming.” When he brought up the newspapers, he said, “We must accelerate our digital offerings and get paid for them.”

Mr. Liguori is best known for his time at News Corporation, where he ran the popular cable channel FX and then became the chairman of entertainment for Fox Broadcasting. In 2009, he joined Discovery Communications as chief operating officer.

Eddy W. Hartenstein, Tribune’s previous chief executive, will remain the publisher of The Los Angeles Times and will be a special adviser to Mr. Liguori’s office, Tribune said Thursday.

The company also said Bruce Karsh, the president of the private equity firm Oaktree Capital Management, had been elected the chairman of Tribune’s new board. Oaktree owns nearly a quarter of Tribune. Mr. Karsh said in a statement: “The company is well-positioned across its markets and now has a strong balance sheet, significant liquidity and low debt, so there is a lot of opportunity ahead.”

U.S. finalizes rules for financial firms to avoid foreclosures









In a major effort to heal the $10-trillion U.S. mortgage market, the Consumer Financial Protection Bureau has finalized rules designed to ensure financial firms offer every available option to keep delinquent borrowers in their homes.


The regulations, to be announced Thursday, address widespread complaints that loan servicers — the companies that collect mortgage payments and repossess homes — were woefully unprepared to help borrowers during the tsunami of foreclosures after the housing bust.


They are designed to complement previous settlements by major banks over allegations of widespread servicing and foreclosure abuses. But unlike earlier settlements, they will apply to all large mortgage servicers, not just banks, in all states.





Still, the rules drew immediate criticism from a prominent consumer group, which said they don't do enough to force servicers to consider easing the terms of mortgages and expressed fears that the rules might preempt stronger existing provisions.


"While the establishment of industrywide standards is important, the failure to require meaningful loan modification protections is a retreat from current safeguards under the soon-to-expire [Obama administration] loan modification program," said Alys Cohen, an attorney with the National Consumer Law Center.


The consumer bureau was created when Congress passed the sweeping Dodd-Frank financial reform act in reaction to the mortgage meltdown and the global economic crisis that ensued. The law also required lenders to ensure that they only make loans that borrowers can reasonably be expected to repay.


Last week, the bureau issued major regulations providing a "safe harbor" from lawsuits under that new requirement for lenders who make certain types of presumably sound home loans. A key requirement is that total debt payments for borrowers — including principal, interest, taxes and insurance on home loans — be no more than 43% of gross income.


The rules to be released Thursday, which take effect in a year, bar lenders from pursuing foreclosure proceedings against borrowers while applications for loan modifications are pending — the much-criticized practice of "dual tracking."


The consumer bureau said banks also must provide "direct, easy, ongoing access" to employees who are required to alert borrowers to missing information, provide status reports on modification requests and ensure documents don't get lost.


Banks also are required to inform borrowers who miss two monthly payments about options to avoid foreclosure and to wait until loans go 120 days delinquent before beginning a foreclosure — a provision that would preempt a 90-day requirement under California law.


Richard Cordray, the consumer bureau's director, said distressed borrowers had not gotten the help and support they deserved, such as "timely and accurate information about their options for saving their homes."


"Servicers failed to answer phone calls, routinely lost paperwork and mishandled accounts," Cordray said in remarks to be delivered at an industry conference Thursday.


"Communication and coordination were poor, leading many to think they were on their way to a solution, only to find that their homes had been foreclosed on and sold," he said. "At times, people arrived home to find they had been unexpectedly locked out."


The new rules don't apply to most small banks and credit unions. Bureau officials said they have had few complaints about these small institutions, which are more likely to keep loans on their books, rather than sell them, and generally devote more attention to individual customers.


Servicers often are collecting payments on behalf of loan owners, who may be the banks themselves but more often are trusts created on behalf of mortgage investors. The investors have mandated a wide range of relief programs for troubled borrowers in addition to government-sponsored programs such as the Obama administration's Home Affordable Modification Program.


In the past, servicers would sometimes not inform troubled borrowers about all the options, instead steering them into foreclosure or programs that provided the servicers with greater financial rewards, bureau officials said.


The servicers are now supposed to clearly explain all alternatives to borrowers so they can pick the best one. The new rules also establish clearer opportunities for borrowers to appeal servicers' denials of loan modifications.


In addition to worries that the bureau has not cracked down hard enough on servicers, consumer advocates expressed concern that the new rules will not take effect for a year.


"While we understand that servicers need time to implement complex procedures, we're still in the middle of a foreclosure crisis," Cohen said. "Many people will unnecessarily lose their homes if we wait a year."

Pregnant Kim Kardashian wants to be more private






NEW YORK (AP) — As the tabloids speculated about whether Jessica Simpson is expecting again (she is) and the media zeroed in on Kate Middleton‘s acute morning sickness, Kim Kardashian says it was nice to be out of the media spotlight during the early stages of her pregnancy.


“I’m obviously so happy for them, but if anything I loved the privacy,” the 32-year-old reality TV star said in an interview Wednesday.






That bit of privacy went out the window when Kardashian’s boyfriend, Kanye West, revealed during a Dec. 30 concert in Atlantic City, N.J., that they are expecting their first child together.


Now that the word is out, Kardashian says her motherly instincts have made her pull back from being so open about her personal life.


“I think that definitely kicks in where you’re like, ‘OK, I have to go in protect mode,’ and as ironic as it sounds, you live your life on a reality show but then when you grow up … certain things change your life that make you want to be more private and this is definitely one of them.”


The couple went public with their relationship in March.


Kardashian married NBA player Kris Humphries in August 2011 and their divorce is not finalized.


West rarely grants interviews, and the 35-year-old rapper is the ying to the Kardashian family’s “out there” yang. Kardashian says she is somewhat influenced by West’s approach.


“When you spend time with someone, you learn things from them, so I see what (his) views are in wanting to be private, so that’s a choice we make together as a family just in how we’re gonna raise our kid,” she said. “… But my personal experience of having really open relationships on the show, I’ve done that, and for me I feel like I got really scrutinized when people didn’t maybe understand my decisions at some point, so I feel like after that experience I’ve become more private more so than just like Kanye’s views or anything.”


Kardashian is due in July.


A new season of her reality show with her sister Kourtney, “Kourtney and Kim Take Miami,” premieres Sunday on E! (9 p.m. EST).

Some With Autism Diagnosis Can Recover, Study Finds


Doctors have long believed that disabling autistic disorders last a lifetime, but a new study has found that some children who exhibit signature symptoms of the disorder recover completely.


The study, posted online on Wednesday by the Journal of Child Psychology and Psychiatry, is the largest to date of such extraordinary cases and is likely to alter the way that scientists and parents think and talk about autism, experts said.


Researchers on Wednesday cautioned against false hope. The findings suggest that the so-called autism spectrum contains a small but significant group who make big improvements in behavioral therapy for unknown, perhaps biological reasons, but that most children show much smaller gains. Doctors have no way to predict which children will do well.


Researchers have long known that between 1 and 20 percent of children given an autism diagnosis no longer qualify for one a few years or more later. They have suspected that in most cases the diagnosis was mistaken; the rate of autism diagnosis has ballooned over the past two decades, and some research suggests that it has been loosely applied.


The new study should put some of that skepticism to rest.


“This is the first solid science to address this question of possible recovery, and I think it has big implications,” said Sally Ozonoff of the MIND Institute at the University of California, Davis, who was not involved in the research. “I know many of us as would rather have had our tooth pulled than use the word ‘recover,’ it was so unscientific. Now we can use it, though I think we need to stress that it’s rare.”


She and other experts said the findings strongly supported the value of early diagnosis and treatment.


In the study, a team led by Deborah Fein of the University of Connecticut at Storrs recruited 34 people who had been diagnosed before the age of 5 and no longer had any symptoms. They ranged in age from 8 to 21 years old and early in their development were in the higher-than-average range of the autism spectrum. The team conducted extensive testing of its own, including interviews with parents in some cases, to gauge current social and communication skills.


The debate over whether recovery is possible has simmered for decades and peaked in 1987, when the pioneering autism researcher O. Ivar Lovaas reported that 47 percent of children with the diagnosis showed full recovery after undergoing a therapy he had devised. This therapy, a behavioral approach in which increments of learned skills garner small rewards, is the basis for the most effective approach used today; still, many were skeptical and questioned his definition of recovery.


Dr. Fein and her team used standardized, widely used measures and found no differences between the group of 34 formerly diagnosed people and a group of 34 matched control subjects who had never had a diagnosis.


“They no longer qualified for the diagnosis,” said Dr. Fein, whose co-authors include researchers from Queens University in Kingston, Ontario; Children’s Hospital of Philadelphia; the Institute of Living in Hartford; and the Child Mind Institute in New York. “I want to stress to parents that it’s a minority of kids who are able to do this, and no one should think they somehow missed the boat if they don’t get this outcome.”


On measures of social and communication skills, the recovered group scored significantly better than 44 peers who had a diagnosis of high-functioning autism or Asperger’s syndrome.


Dr. Fein emphasized the importance of behavioral therapy. “These people did not just grow out of their autism,” she said. “I have been treating children for 40 years and never seen improvements like this unless therapists and parents put in years of work.”


The team plans further research to learn more about those who are able to recover. No one knows which ingredients or therapies are most effective, if any, or if there are patterns of behavior or biological markers that predict such success.


“Some children who do well become quite independent as adults but have significant anxiety and depression and are sometimes suicidal,” said Dr. Fred Volkmar, the director of the Child Study Center at the Yale University School of Medicine. There are no studies of this group, he said.


That, because of the new study, is about to change.

DealBook: Report Details Missteps in Trading at JPMorgan

Long seen as one of the most careful banks on Wall Street, JPMorgan Chase on Wednesday drew back a curtain on a rare breakdown, showing traders acting on their own and concealing losses while managers seemingly turned a blind eye.

In a 129-page internal report dissecting a bad bet on credit derivatives that cost the bank more than $6 billion, the bank confessed, in painstaking detail, to widespread “failures.”

Yet the report, written by a JPMorgan management task force, is not the final word on the trading blunder. Federal investigators are examining whether fraud was committed and are planning to use the report as a guide for pursuing their inquiries, say officials briefed on the matter.

The report describes traders making overly optimistic estimates of their losses, but stops short of claiming outright fraud. Showing that traders crossed a legal line presents a challenge for investigators. In some derivatives markets, traders are afforded flexibility to estimate the value of their positions.

But the F.B.I., suspecting that some employees intentionally hid the losses last year, is using taped phone conversations to build criminal cases against London-based traders involved in the debacle, according to the officials briefed on the matter. And the report could help that effort, the officials said. Authorities expect to interview one of the junior traders in the coming weeks, one official said.

Congress is exploring potential wrongdoing, as well. The Permanent Subcommittee on Investigations has taken testimony, people close to the inquiry said, from Jamie Dimon, the bank’s chief executive, and Ina R. Drew, the former leader of the chief investment office,where the trading losses occurred.

The subcommittee’s investigation has already complicated things for the bank. It is rare for a bank to expose its missteps so publicly, but JPMorgan knew that the subcommittee would have eventually received the document from regulators and made it public.

The regulators at the Office of the Comptroller of the Currency, the people close to the inquiry said, are required to turn over such documents under a subpoena they received from the subcommittee. So last fall, a person close to JP Morgan said, the bank decided to release the report on its own terms.

“This was getting out there anyway,” another person close to the situation said. This person and others interviewed for this article spoke on the condition of anonymity because the details of the case are not public.

Federal authorities responded positively to the internal report. One Congressional official privately told JPMorgan that the bank was wise to release such a detailed document, one person briefed on the matter said, while some regulators at the comptroller’s office praised it as an “important step” for corporate governance.

The report centered on a breakdown at the chief investment office in London, a group created to invest JPMorgan’s own money and offset potential losses across the bank’s disparate businesses.

JPMorgan’s troubles began in January 2012, when the investment office ignored the basic rules of trading. On a well-functioning Wall Street desk, traders are told to end a deeply vulnerable position early, even if it means sustaining some minor losses.

But under Ms. Drew, the report said, JPMorgan traders did the opposite. In response to adverse moves in the markets and regulatory changes, the group made a series of aggressive derivatives trades. As these bets began to sour, the London team increased their trades rather than exiting. The traders thought that reducing the assets was too costly, the report says.

Some questioned the strategy. By the end of January, one trader became deeply unnerved. In an e-mail to a more senior trader, he said the size of the trades were becoming “scary” and advised that the unit take the “full pain” now.

But the traders “continued to build the notional size of the positions through late March,” according to the report, which was led by Michael J. Cavanagh, the bank’s co-head of corporate and investment banking.

In an April e-mail, Mr. Dimon asked JPMorgan’s chief risk officer, John Hogan, why the chief investment office hadn’t simply cut some of its positions to reduce risk. The office, Mr. Hogan replied, indicated that adding positions was the “most ‘efficient’ way to do it.”

The report does not name the architects of the trade; British privacy laws prevented it from doing so. But they are known to be Javier Martin-Artajo, a manager who oversaw the trading strategy from the bank’s London offices; Bruno Iksil, the trader known as the London Whale for placing the outsize bet; and Achilles Macris, the executive in charge of the international chief investment office. None of the employees have been accused of any wrongdoing. They have all since departed the bank.

The JPMorgan report, while taking aim at the London office’s strategy, also exposes major gaps in oversight that allowed this headstrong team of traders to carry out their wager. Ms. Drew, who helped steer the bank through the financial crisis, received the brunt of the blame.

“Ina Drew failed in three critical areas,” the report said, pointing to lax controls and a failure to ensure that her team “understood and vetted” the trade.

The management missteps also ensnared Barry L. Zubrow, a former chief risk officer, and Douglas L. Braunstein, formerly the bank’s chief financial officer but now a vice chairman at the bank. While the report acknowledged that Mr. Dimon could “appropriately rely upon” senior managers who oversaw the trading strategy, it also concluded that he “could have better tested his reliance on what he was told.”

This slipshod culture magnified the impact of simple human errors across the bank. At one point, the mathematical mistakes of an employee in London prevented others in the bank from seeing the potential losses accumulating beneath the surface.

Still, the problems lurking in the investment office should have set off alarms for executives outside the office. The report reveals, however, that the bank dismantled its early-warning system.

The investment office’s alarm system, based on a computer model, showed risk limits were exceeded in late January, according to the report. Senior executives made a temporary exemption for the investment office, which was approved by Mr. Dimon and others. But then, the bank introduced a new model that underestimated the losses building in the investment office, and allowed the traders to fly below the bank’s internal risk radar.

The flawed model, the report says, was built by a London-based mathematician who also provided analysis to the investment office’s traders. It appears the employee, who built the model with a simple spreadsheet, was out of his depth. The model wasn’t properly back-tested and contained errors, the report said.

JPMorgan’s report raises the possibility that the investment office pressured the managers to approve the new model. The model-builder received an e-mail on Jan. 23 from the trader to whom he reported, saying that he should “keep the pressure on our friends” in a group that validated models.

The public disclosures by the bank also came under scrutiny in the report. Failure to properly report trading losses could make JPMorgan vulnerable to lawsuits from investors. The bank’s disclosures are the subject of the Congressional investigation and an inquiry from the Securities and Exchange Commission.

The problem stems in part from the London traders, who underestimated the size of their losses, a misstep that has drawn the scrutiny of the F.B.I. and federal prosecutors. The bank restated its first-quarter results to reflect that the traders may have masked their losses by $459 million.

“In the course of the task force’s ensuing work, it became aware of evidence — primarily in the form of electronic communications and taped conversations — that raised questions about the integrity of the marks,” the report said.

Still, obstacles remain for a criminal prosecution. Authorities planned to interview Mr. Macris in his native Greece, but the talks have broken down. Instead, officials said, they now expect to interview a lower-level employee.

Some people close to the investigation also note that traders have some leeway when marking the value of trades. And the internal report shows how JPMorgan, after consulting its auditor, PricewaterhouseCoopers, approved the investment office’s valuations of its trades.

The report highlighted an episode that, in theory, might have made JPMorgan think twice before initially signing off on the first-quarter results. An “internal audit group” identified deficiencies in the unit that double-checked its traders’ valuations, calling out the group last March with a simple concern: it “needs improvement.”

Family of man killed by Santa Ana police disputes city's explanation









The family of a man killed by police in Santa Ana disputed the official chain of events leading to his shooting, saying the 39-year-old had fallen asleep in his parked car and was startled when officers began banging on his vehicle.


The death of Binh Van Nguyen has stirred protests and rumors, fanned by coverage on Vietnamese radio and conversation at local coffeehouses.


In a public outreach effort Monday, Santa Ana city leaders — including Mayor Miguel Pulido and interim Police Chief Carlos Rojas — held a town hall meeting to respond to the rumors and offer reassurance that the shooting is being investigated.





"We hope to show the community we are listening," Cpl. Anthony Bertagna said.


Police said they were forced to open fire with semiautomatic handguns when Nguyen tried to drive his white Toyota toward them in the early hours of last Friday.


Patrol officers cruising through a west Santa Ana neighborhood reported that they first spotted Nguyen sitting in the back seat of his parked car in the 200 block of Maxine Street. As two uniformed men approached, he jumped into the front seat, police said.


The officers said they asked him to exit the car, but instead he gunned it toward them, Bertagna said.


The area where the 12:45 a.m. incident unfolded is a haven for gang activity and drugs, police said.


But family members countered the official version of what happened.


"The crime scene photos show Binh's car in a stationary position curbside, with little or no room to maneuver," the Nguyens said in a statement released by their attorney, Michael Guisti.


The family asserted that the officers were not wearing uniforms and that Nguyen — startled from his sleep — had no way of knowing they were policemen.


"We are grief-stricken beyond words. Binh was a gentle and kind man with a warm personality," the family said.


Supporters staged a peaceful protest Sunday at the scene where Nguyen, who worked in a dry-cleaning shop, was shot. He is survived by his wife and two sons, ages 13 and 7.


"They need to show the greater community that this is a tragedy and police have questions to answer," Guisti said.


Both officers involved in the fatality, one a veteran and the other described as "experienced" but new to the department, are on leave but expected to return to duty.


Police found drug paraphernalia in Nguyen's car, Bertagna said.

Americans favor “Lincoln” for top Oscars: poll






NEW YORK (Reuters) – Director Ben Affleck and “Argo” may have been the big winners at the Golden Globes, but many Americans think Steven Spielberg and “Lincoln” should take home the top Oscars at next month’s awards.


Nearly a quarter of Americans questioned in an Ipsos poll for Reuters thought the Civil War drama “Lincoln” should win the Oscar for best picture at the 85th Academy Awards in Los Angeles on February 24. Spielberg was also their top choice for best director, with 36 percent choosing him.






Only 4 percent of Americans thought “Argo,” which depicts the rescue of American diplomats in Iran in the 1970s, should win the Academy Award for best picture.


The poll results have little if any implication for who will ultimately win the Oscars, which are voted on by movie industry professionals.


The Golden Globes are sometimes looked to for hints on the eventual Oscar victors, the biggest prizes in the film industry, as many Globe winners have gone on to Oscars success. But Affleck is not even in the running for best director after he was snubbed by the Academy of Motion Picture Arts and Sciences which announced its nominations last week.


Americans chose Daniel Day-Lewis as their clear favorite to follow up his Golden Globe win for his portrayal of Abraham Lincoln with a best actor Oscar.


Twenty-two percent chose him over Denzel Washington in “Flight,” who polled 16 percent while Hugh Jackman, who won a Golden Globe for his role in the musical “Les Miserables” was third.


But the choice for best actress was less clear cut. Twelve percent of the 1,158 Americans polled voted for Naomi Watts as the distraught mother in the tsunami drama “The Impossible,” followed by 10 percent for Jennifer Lawrence in “Silver Linings Playbook” and 9 percent for Jessica Chastain in the search for Osama Bin Laden thriller, “Zero Dark Thirty.”


Lawrence won the Golden Globe on Sunday for best actress in a comedy or musical, while Chastain took home the prize for best actress in a drama.


“Lincoln” was also the top choice in the poll for the supporting categories, with Tommy Lee Jones and Sally Field favorites for their performances in the film.


Comedians Tina Fey and Amy Poehler, who won praise for their first stint hosting the Golden Globes, will be a hard act to follow but 42 percent of Americans approved of the choice of outspoken comedian and creator of “Family Guy” Seth MacFarlane to helm the Academy Awards.


If given the opportunity to select the host for the Oscars, 15 of people said they would opt for comedian Billy Crystal, followed by 12 percent who chose Ellen DeGeneres while 10 percent wanted Steve Martin.

Breaking Link of Violence and Mental Illness





No one but a deeply disturbed individual marches into an elementary school or a movie theater and guns down random, innocent people.




That hard fact drives the public longing for a mental health system that produces clear warning signals and can somehow stop the violence. And it is now fueling a surge in legislative activity, in Washington and New York.


But these proposed changes and others like them may backfire and only reveal how broken the system is, experts said.


“Anytime you have one of these tragic cases like Newtown, it’s going to expose deficiencies in the mental health system, and provide some opportunity for reform,” said Richard J. Bonnie, a professor of public policy at the University of Virginia’s law school who led a state commission that overhauled policies after the 2007 Virginia Tech shootings that left 33 people dead. “But you have to be very careful not to overreact.”


New York State legislators on Tuesday passed a gun bill that would require therapists to report to the authorities any client thought to be “likely to engage in” violent behavior; under the law, the police would confiscate any weapons the person had.


And in Washington, lawmakers said that President Obama was considering a range of actions as part of a plan to reduce gun violence, including more sharing of records between mental health and law enforcement agencies.


The White House plan to make use of mental health data was still taking shape late Tuesday. But several ideas being discussed — including the reporting provision in the New York gun law — are deeply contentious and transcend political differences.


Some advocates favored the reporting provision as having the potential to prevent a massacre. Among them was D. J. Jaffe, founder of the Mental Illness Policy Org., which pushes for more aggressive treatment policies. Some mass killers “were seen by mental health professionals who did not have to report their illness or that they were becoming dangerous and they went on to kill,” he said.


Yet many patient advocates and therapists strongly disagreed, saying it would intrude into the doctor-patient relationship in a way that could dissuade troubled people from speaking their minds, and complicate the many judgment calls therapists already have to make.


The New York statute requires doctors and other mental health professionals to report any person who “is likely to engage in conduct that would result in serious harm to self or others.”


Under current ethical guidelines, only involuntary hospitalizations (and direct threats made by patients) are reported to the authorities. These reports then appear on a federal background-check database. The new laws would go further.


“The way I read the new law, it means I have to report voluntary as well as involuntary hospitalizations, as well as many people being treated for suicidal thinking, for instance, as outpatients,” said Dr. Paul S. Appelbaum, director of the Division of Law, Ethics, and Psychiatry at Columbia University’s medical school. “That is a much larger group of people than before, and most of whom will never be a serious threat to anyone.”


One fundamental problem with looking for “warning signs” is that it is more art than science. People with serious mental disorders, while more likely to commit aggressive acts than the average person, account for only about 4 percent of violent crimes over all.


The rate is higher when it comes to rampage or serial killings, closer to 20 percent, according to Dr. Michael Stone, a New York forensic psychiatrist who has a database of about 200 mass and serial killers. He has concluded from the records that about 40 were likely to have had paranoid schizophrenia or severe depression or were psychopathic, meaning they were impulsive and remorseless.


“But most mass murders are done by working-class men who’ve been jilted, fired, or otherwise humiliated — and who then undergo a crisis of rage and get out one of the 300 million guns in our country and do their thing,” Dr. Stone said.


The sort of young, troubled males who seem to psychiatrists most likely to commit school shootings — identified because they have made credible threats — often do not qualify for any diagnosis, experts said. They might have elements of paranoia, of deep resentment, or of narcissism, a grandiose self-regard, that are noticeable but do not add up to any specific “disorder” according to strict criteria.
